Jeffrey L. Smith, Petitioner-appellant, v. Warden, Buckingham Correctional Center, Respondent-appellee
United States Court of Appeals, Fourth Circuit. - 952 F.2d 396
Submitted Oct. 28, 1991.Decided Jan. 2, 1992
Appeal from the United States District Court for the Western District of Virginia, at Roanoke. (CA-91-135-R), Jackson L. Kiser, District Judge.
Jeffrey L. Smith, appellant pro se.
Eugene Paul Murphy, Office of the Attorney General of Virginia, Richmond, Va., for appellee.
W.D.Va.
DISMISSED.
Before ERVIN, Chief Judge, SPROUSE, Circuit Judge, and CHAPMAN, Senior Circuit Judge.
PER CURIAM:
Jeffrey L. Smith seeks to appeal the district court's order refusing habeas corpus relief pursuant to 28 U.S.C. § 2254. Our review of the record and the district court's opinion discloses that this appeal is without merit. Accordingly, we deny a certificate of probable cause to appeal and dismiss the appeal on the reasoning of the district court. Smith v. Warden, No. CA-91-135-R (W.D.Va. July 11, 1991). We dispense with oral argument because the facts and legal contentions are adequately presented in the materials before the Court and argument would not aid the decisional process.
DISMISSED.
